This Terms and Conditions Agreement (“Agreement”) states the terms and conditions under which you may access and use the Vancouver Biennale Web site (the “Web Site”). Please read these Terms and Conditions carefully before using the Web Site. By using the Web Site you signify your consent to these terms and conditions. If you are dissatisfied with the terms, conditions, rules, policies, guidelines or practices of the Web Site, please discontinue using it.
The Vancouver Biennale is a non-profit corporation created pursuant to Part 2 of the Canada Corporations Act and a registered charity having its principle office in Vancouver. The Vancouver Biennale owns and operates the Web Site located at http://vblearn.ca.
The Vancouver Biennale may revise this Agreement at any time by updating this posting. Use of the Web Site after such changes are posted will signify your agreement to these revised terms. You should visit this page periodically to review this Agreement.
TERMS & CONDITIONS
Ownership of Materials
1. You should assume that everything you see or read on the Web Site is protected by copyright unless otherwise stated and may only be used according to these Terms and Conditions. Everything on this website (including the underlying HTML, text, games, designs, icons, documents, articles, applications, products, software and all other website content, as defined below (the "Content") is either owned by the Vancouver Biennale or is owned by the original creator or their assignee, in which case the Vancouver Biennale is using the Content under license or contract. The use of the Content by you, or anyone else authorized by you, is prohibited unless specifically permitted by this Agreement. Any unauthorized use of the Content may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.
2. All trade-marks used and/or displayed on this website (including “kcrewgame.com”, “vblearn.ca”, “vancouverbiennale.com” are registered or unregistered trademarks of the Vancouver Biennale. Nothing on this website should be construed as granting any license to use any trademark displayed on this website.
Permitted Uses
3. You may display and view the Content on your computer. You may view or listen to the sample video and audio files and you may print all or any part of the Content. You may only use the Content for personal purposes unless you have a separate written agreement with the Vancouver Biennale that permits further uses. You are not permitted to modify the Content without permission from the Vancouver Biennale. You are not permitted to make use of the Content for commercial gain. You must keep intact all copyright notices for the Content and provide, reasonable to the medium or means you are utilizing, the name of the Vancouver Biennale and the title of the Content if supplied. Such credit may be provided in any reasonable manner, provided, however, that in the case of a collective work, at a minimum such credit will appear where any other comparable authorship credit appears and in a manner at least as prominent as such other comparable authorship.

Limitation of Liability
8. Under no circumstances, including, but not limited to, negligence on behalf of the Vancouver Biennale, shall the Vancouver Biennale, its officers, employees, agents or contractors be liable for any direct, indirect, special, punitive, incidental or consequential damages arising out of the use of, or the inability to use, the Web Site and/or the products sold on the Web Site or any sites linked to the Web Site, even if the Vancouver Biennale or an authorized representative has been advised of the possibility of such damages. If your use of materials from the Web Site or any sites linked to by the Web Site results in personal injury or the need for servicing, repair or correction of computer equipment or data, you assume any costs thereof.
9. In no event shall the Vancouver Biennale’s total liability to you for any damage, loss and/or cause of action exceed the amount paid by you, if any, for accessing the Web Site. This limitation of liability shall survive the termination of this Agreement.

The Vancouver Biennale has not reviewed all of the sites linked to the Web Site, or the contents of third party websites providing links to the Web Site, and is not responsible for the contents of any third party pages or any other websites linked to the Web Site. Any link to or from such third party websites is provided for your convenience only. The Vancouver Biennale does not endorse, recommend, authorize, approve, certify, maintain, or control these other websites and does not guarantee the accuracy, completeness, efficacy or timeliness of the information located at such websites. Your linking to or from any third party pages or other websites is at your own risk.
11. The Vancouver Biennale disclaims all warranties, express or implied, as to the accuracy, legality, reliability or validity of any content on any other site and disclaims all responsibility for any loss, injury, claim, liability or damage of any kind resulting from any third party websites or content therein directly or indirectly accessed through links in the Web Site.
12. The Vancouver Biennale is not responsible for the privacy practices of third party websites. We encourage you to review the privacy policies of any linked websites before you navigate any website or disclose your personal information online.
13. Any communication or material you transmit to the Web Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by the Vancouver Biennale or its affiliates for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast, and posting. Furthermore, the Vancouver Biennale is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Web Site for any purpose whatsoever, including but not limited to developing and marketing products or programs using such information.
Termination
14. The Vancouver Biennale may terminate any licenses granted in this Agreement at any time. Upon termination, you must immediately cease use of the Content.
